Court Ruling Causes Confusion on Retroactive Interest Rates

El-Khodr v Lackie, 2015 ONSC 4766 – This action arose from damages relating to the catastrophic injuries sustained by Mr. Kossay El-Kohdr during a motor vehicle accident when his car was rear-ended by Mr. Raymond Lackie, while he was driving Mr. John McPhail’s car. After the trial, the Plaintiff was awarded $2,931,006.00 in damages and the parties were instructed to provide submissions in regards to the assignment of past and future collateral benefits, prejudgment interest and costs.
