Hinse v. Canada (Attorney-General), 2015 CSC 35
When a person abuses his right to institute legal proceedings, he could be required to pay the extra-judicial fees incurred by the other party as damages. This is true even if the other party was represented by pro bono attorneys (acting on a no-fee basis). In 1964, Hinse was wrongfully sentenced to 15 years in prison for armed robbery. Hinse filed many requests for clemency with the Minister in efforts to obtain a pardon, but none of his requests were granted.
