Summary Judgment Granted in Social Host Liability Case

In Robinson v Lewis, 2015 ABQB 385, CBM Lawyers successfully defended a social host in a claim for injuries arising from an assault between two party guests. The claim was dismissed following a summary judgment application on the grounds that the assault was spontaneous, and as such, not foreseeable. Madam Justice D.A. Yungwirth held that because the injury to the Plaintiff was not foreseeable, the branch for the test for establishing a duty of care had not been met.
