The Court dismissed the Plaintiffs’ claim against a construction supply company, which claim alleged an agency relationship between the company and one of the Certified Installers of its products. The Court held that there was no evidence of any agency relationship. The only legal relationship between the construction supplies company and the Certified Installer was one of seller-purchaser. As such, there was no liability in negligence or contract against the company for the Certified Installer’s allegedly improper workmanship. Read the full decision here:
