The Government of Alberta is working to implement some important changes to the procedures and processes in the Provincial Court of Alberta – Civil Division. As of August 1, 2014, the Provincial Court ‘s jurisdiction to award damages will be increased from $25,000.00 to $50,000.00. This increased damages limit will have a significant impact on subrogated claims and insurance defense files. Subrogated claims for amounts over $25,000.00 will be able to be filed in the Provincial Court of Alberta after August 1, 2014. However, if a subrogated claim is filed before August 1, 2014, we will not be permitted to amend our pleadings to increase damages to amounts over $25,000.00. As such, it is important that insurers and legal counsel pay close attention to their limitations deadlines, and file subrogated claims after August 1, 2014 where at all possible if the damages sought exceed $25,000.00.
