In this case, the Court of Appeal has determined that when establishing the loss of a deceased person’s future earnings, we should look at the average annual salary that this person’s program of study would have enabled him to achieve rather than the maximum salary of the desired profession. Even if the deceased person was a brilliant university student, it is impossible to know how this person would have behaved in the workplace or how successful he would have been professionally. Based on Vietnamese tradition, the parent’s claim regarding a loss of financial support was also allowed.
