Effective September 1, 2014 The Alberta Rules Of Court Amendment Regulation (AR 41/2014) brought into force the new Alberta Court of Appeal rules (the “New Rules”), which form Part 14 of the Alberta Rules of Court. The New Rules are based on the presumption that the underlying trial procedure in the Rules of Court will apply to appeals, unless specifically excluded or modified. The exception to this general rule relates to Rule 13.5 of the Alberta Rules of Court, which allows parties to extend deadlines by agreement. Extensions by consent are not permitted by the New Rules.
